When most litigators think of jury research, they think of conducting a mock trial sometime between the submission of summary judgment briefs and the trial date. This is what we call “confirmatory” jury research – it is meant to help test and refine key themes, arguments, documents and witnesses before trial. Essentially, it is road-testing the case before trial. Confirmatory research with The Caissa Group can take many forms and each project is designed in collaboration with the client. However, all confirmatory research projects will include jury-eligible, demographically matched surrogate jurors who will observe case presentations provided by counsel and provide extensive feedback via questionnaires and small group deliberations. The overall protocol is customized individually for each case, to make sure it will address the client’s questions and concerns.
